In the following "this site" and "the site" are taken to mean the domains " bethanysweet.com" and any or all of the domain names owned and operated by Bethany Sweet and SweetBethany.com/BethanySweet.com. The domains owned at the time of writing are bethanysweet.com and sweetbethany.com. If in doubt please use the Internet tool WHOIS to determine ownership. These terms and conditions apply to ALL websites owned and operated by Bethany Sweet and SweetBethany.com/BethanySweet.com.

The machine these sites are run from is at a data center owned by karco.net in Indiana in the USA.

The merchandise sales staff are located in Bellevue, WA, USA. The webmaster is located in the US. All enquiries by post may be sent to: BethanySweet.com, 15600 NE 8th Street Suite B1 #313, Bellevue, WA 98008. Billing and customer service is handled by CCBill.

CREDIT CARDS

1. We use CCBill to provide our card processing infrastructure. The highest level of security and anti-fraud measures exist in their systems to ensure your transactions are safely made over the internet.

2. All credit card purchases will be billed as "CCBill" which is what you will see on your card statements.

3. No card details are stored on our server. All card information remains with CCBill. Card numbers are not available to anyone but CCBill and our authorized sales staff. Card numbers are at no point transmitted over the internet without industry standard (128 bit SSL) encryption being applied. This is the strongest form of encryption commonly used for transactions on the web.

4. The only details stored locally on our server are those concerning membership purchases. In this case the order reference number, email address of the transaction, dates and a username/password are stored for the purposes of running and administrating the member ship account. No other details are kept locally. These details are not accessible via any of the public interfaces of the site and are only available to authorized technical staff on a per IP/Computer basis.

5. NEVER send us credit card numbers via email. We cannot take orders this way and will reject any such order. Doing so is highly unsafe and may compromise your credit card. Please do not do it.

6. If you have any dispute about a transaction made with your card please contact us at the appropriate address above and we will resolve it as quickly as possible.

7. We reserve the right to additionally manually review the details of transactions made from certain countries we consider high risk and optionally to reject such transactions. We also reserve the right to run additional checks against orders originating from free email accounts. Both such orders may be held up while additional verification is performed. We ask for your patience with this procedure which is designed to prevent fraud and is in everyone's interest. 8. We reserve the right to reject any transaction.

9. Rejected transactions will not be charged anything in any way. Nothing will appear on the rejected cards statement.

10. Transactions which are delayed due to a need for additional review may be cancelled at any time by emailing the appropriate email address above.

11. A successful credit card transaction will always be emailed a receipt.

12. To be successful an order MUST BE associated with a valid email address. Any order with an invalid email address will be refunded and rejected.

MEMBERSHIP

1. By gaining access to and logging into the members area you agree you have read understood and abide by these terms and conditions which are presented to you for approval before you make your purchase. You agree that

    i) you are not offended by sexual imagery and multimedia of an erotic nature.

    ii) you confirm that you have intentionally purchased membership to the membership area of the site for the time   period you selected.

    iii) you also agree that you are taking complete and total responsibility for your actions in joining the members site and will not take any legal action against the webmaster/host(s), or any other connected parties, based on your decision to join the members area of the site.

    iv) you confirm that you are not being forced by anyone to join the members site against your will.

    v) you understand the laws of your community regarding adult material and are not breaking them by entering the site.

    vi) you are of sound mind.

2. Fees for membership are paid in advance and are not refundable for part months. Cancellations merely stop the rebilling process. No refunds are applicable on part usage of membership. In other words you pay for the next period (1 month or 3 months) in advance and you cannot claim back on the remainder of the period you cancel in.

3. A refund will ALWAYS be given should you change your mind immediately after making your membership purchase and providing you have not made use of the membership area. We reserve the right to determine whether you did make use of the site by examining our machine logs.

4. By logging in and making use of your account you confirm you are of legal age to view adult material and that you wish to view such material and that you are familiar with all local laws in your area affecting your legal right to access erotica or adult-oriented materials; that you have the legal right to access adult-oriented materials, and that the site has the legal right to transmit them to you; that you are requesting adult-oriented materials for your own private enjoyment and that you will never share these materials with a minor or in ANY WAY make these materials available to a minor.

5. By logging into the site and making use of it your first payment becomes non-refundable as you have received access to the website. If you have signed up for 1 month this means 1 months fee will be charged and is not refundable. The same is true of a purchase for 3 months membership. By logging on you are committing yourself to the term you have paid for.

6. In general refunds for membership are not entertained except for:

• Mistaken Transactions (before the account is activated / used)
• Fraudulent Transactions
• Any mistaken or incorrect billing amounts

7. You may cancel any time you wish by visiting CCBill customer support pages. If you have any other difficulty cancelling email your username to us at the membership queries email address above and we will cancel your account for you.

8. Password piracy is theft. We operate a password protection mechanism that detects access to the site by simultaneous multiple IP addresses. If you repeatedly give away your username or password details or leave them insecure so that they are stolen your membership will be forfeit immediately with no refund. Furthermore you will not be permitted to join the site again. Please keep your login details secure.

9. You may not resell or trade your account. Any account that is found to have been traded will be cancelled immediately with no refund.

10. Please note that linked sites are not under the control of this site (and/or the webmaster), so we cannot be held responsible for any linked site, or any link contained in a link site. Links are only included in this site as a convenience, and the inclusion of any such links does not imply endorsement.

11. By logging on you agree to be personally liable and fully indemnify the site against any damages resulting from your use of the site.

12. We do not guarantee 100% uptime and availability of the website. We do not issue refunds for periods of downtime. We also do not issue refunds on downtime or inaccessibility due to individual accounts being broken into by hacking or password theft and therefore being automatically disabled to prevent abuse and collapse of the system for other users. We will however do all we can to keep any downtime minimal. We also cannot guarantee accessibility in circumstances beyond our control (e.g. terrorist attack on the data center etc.). We will always publicize controlled periods of downtime (for hardware upgrades etc) on the home page of the website in the news section at least 24 hours in advance.

MERCHANDISE SALES

1. We will refund any merchandise returned within 15 days of receipt by the customer providing it is returned as new and undamaged.

2. Should merchandise arrive damaged contact sales@ bethanysweet.com immediately with a description of the damage. We will either refund on return of the damaged goods or replace.

3. All merchandise is sent discreetly in plain packaging material.

4. Goods will be dispatched in a timely manner so as to arrive at the very latest within the US within 28 days of ordering. Internationally please allow 56 days. Some items are dependant on stock. In most cases the website will reflect stock levels, however if your order is delayed for any reason we will contact you. You may then choose to wait or accept a full refund.

5. Any goods not yet dispatched may be cancelled and a full refund given.

PRIVACY

NOTE: The only information stored at bethanysweet.com is your order number, account type and username, password. No address details, card details or any other personal information are stored at bethanysweet.com. Card details, address details and any other information you give in the process of making a purchase are stored only at our card processor (CCBill) systems and are only used for the purposes of billing verification. The following points apply to information on both systems:

1. We respect your right to privacy and will do everything we can to protect that right.

2. IMPORTANT: We do NOT sell or give ANY member details AT ALL to third parties, other members of the site or anyone else NOT directly involved with bethanysweet.com or it's billing systems. The only people with access to this information are trusted and authorized employees of bethanysweet.com and CCBill our card processors.

3. Members details will only be used for the purposes of administrating the website and verification of billing.

The following applies to information kept on bethanysweet.com - i.e. your email and account details - it does NOT apply to your credit card and address information. See below for more information about those.

4. Although we will do our best to make sure your details remain secure and private we cannot be held responsible for:

• Unforeseen Software/Hardware errors that fail in such a way as to leave your details exposed. This is however extremely unlikely and has never happened to date on any systems run by bethanysweet.com technical staff.
• Hacking. Although we have the most stringent anti-hacking measures in place and only allow access to our servers via designated IP addresses the possibility always exists that hackers will find a new way to exploit systems (on just about any site actually)
• Human Error. We are all human and mistakes can sometimes be made. We will try our utmost to prevent this happening but again cannot be held responsible for the unforeseen.

In all cases should problems occur we will try to limit any damage and fix any problems as soon as is humanly possible.

The following applies to your Credit Card information and personal details / address details.

5. CCBill is our card processor and handle all sensitive card details, billing information and address details. All such information never leaves their systems.

COPYRIGHT

1. All material on the site is the copyright of the photographers involved and/or of SweetBethany.com/BethanySweet.com. Posting to newsgroups or reuse on other websites or linking to pictures on this site are all strictly prohibited. If you are found to be doing any of these your membership will be forfeit immediately with no refund and you will not be permitted to rejoin the site again. Please bear in mind that by stealing images in this way you are hurting Bethany Sweet directly and making continued operation of the website difficult. If you suspect piracy of pictures from the website please email info@ bethanysweet.com with the URL of the site you suspect is misusing Bethany's material.

VARIATION

We may change and vary these terms and conditions from time to time. By agreeing to these terms and conditions you acknowledge our right to do so.
